Prosecutors in Suffolk last week issued an indictment against Kimberly Artis, 39, and her boyfriend, Steven Bullock, 51, charging them with the death of Artis' 2-year-old granddaughter, Destiny Riddick, in July 2011.
Police in Portsmouth nabbed Bullock at around 4 a.m. on Friday, but Artis was still at-large, WTKR television reported.
After the indictments were issued, Artis reportedly told police that the couple would turn themselves in, but they never did. Destiny was found unconscious at the couple's home on July 17, 2011, and died later at a hospital.
Toxicology reports showed the tot overdosed on Suboxone, a drug that treats addiction to prescription painkillers or heroin. Investigators said the pills were kept in a candy dish at the couple's home.
Bullock's brother, Harvey, told WTKR that the drugs belonged to a friend.
A cousin of Artis’ told the station that the young grandmother was battling a drug problem and getting her life “on track” after after a recent prison stint.
The couple faces felony murder, felony child abuse or neglect and drug possession charges.
